ENTIRE AGREEMENT: This agreement contains the entire understanding between Innovative
Advantage and the Client. The only way to add to or change this agreement is
to do so in writing, signed by all parties.
RESERVATION: A signed contract and down payment are required to receive the specified goods and services. On signing of this agreement by both parties, Innovative Advantage will reserve the time agreed upon and will not make another reservation for that specific time frame. For this reason, all deposits are non-refundable even if the date is changed or if the wedding becomes cancelled for any reason.
PAYMENT SCHEDULE: 25% due at the time of signing of this agreement. If the down payment is paid by check and the check is returned, the contract is void and the date is no longer secured. Balance payable in full prior to the commencement of the wedding ceremony. No videoing will take place and no rights are granted until timely payment is made in full.
LIMIT OF LIABILITY: If Innovative Advantage cannot perform this agreement in whole or in part due to fire or other casualty, acts of God or nature, or other cause beyond the control of the parties, or due to videographers’ illness or injury, then Innovative Advantage will return all fees to the Client(s), but shall have no further liability with respect to this agreement. This limitation of liability shall also apply in the event that videographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of Innovative Advantage. Innovative Advantage will take utmost care to produce a video of good quality; however, we will not be held responsible for circumstances beyond our control. Furthermore, Innovative Advantage makes not guarantees, either expressed or implied, in regard to aesthetic qualities of the completed video. Client(s) agrees that an entire wedding cannot be replicated, reenacted, or repeated for the purpose of a reshoot and limits Innovative Advantage’s liability to the amount paid under this contract.
MODEL RELEASE AND COPYRIGHTS: The Client(s) hereby grant to Innovative Advantage and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish video or photographs of the Client(s) or in which the Client(s) may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The Client(s) hereby release Innovative Advantage and is legal representatives and assigns from all claims and liability relating to said videos or photographs. In addition, the video is strictly produced for the client(s)’s private, home use only. Any duplication or broadcast without written consent of Innovative Advantage is strictly prohibited. Client(s) assumes all liability for any form of copyright infringement.
HOUSE RULES: The videographer is limited by the guidelines of the ceremony official or reception site management. The client(s) agrees to accept the technical results of their imposition on the videographer. Negotiation with the officials for moderation of guidelines is the Client(s)’s responsibility; Innovative Advantage will offer technical recommendations only.
I/we, the undersigned contracting party, hereby warrant that I am/we are competent to contract in my/our name(s). I/we confirm that we have read the herein agreement prior to its execution and I/we are fully familiar with the contents thereof. This agreement shall be binding upon us and our heirs, legal representatives, and assigns. I/we hereby agree to abide by the terms and conditions of this contract.
